REGINA VS DEAN TWIGG AND KELLY PRECILLA JENKINS

DEAN TWIGG is charged on count one of Grievous Bodily Harm, contrary to section 18 of the Offences Against the Person Act 1861; wherein on the 1st of January 2007, DEAN TWIGG caused Grievous Bodily Harm upon Richard Gardener.

DEAN TWIGG is charged on count two of Grievous Bodily Harm, contrary to section 20 of the Offences Against the Person Act 1861; wherein on the 1st of January 2007, DEAN TWIGG inflicted Grievous Bodily Harm upon Richard Gardener.

KELLY PRECILLA JENKINS is charged on count one of Grievous Bodily Harm, contrary to section 20 of the Offences Against the Person Act 1861; wherein on the 1st of January 2007, KELLY PRECILLA JENKINS caused Grievous Bodily Harm upon Richard Gardener.

It is New Year's Eve; RICHARD GARDENER is an 17 year old on a night out with his brother, GARY GARDENER, who have both decided to go to "Boogie Nights". At (around) 11.30 PM, KELLY PRECILLA JENKINS and RICHARD GARDENER began dancing with each other. DEAN TWIGG interjected himself separating RICHARD GARDENER from his ex-girlfriend, KELLY PRECILLA JENKINS, where an argument took place. All parties seperated. At (around) 12.45PM RICHARD GARDENER left "Boogie Nights" whilst his brother, GARY GARDENER, called for a Taxi. KELLY PRECILLA JENKINS is alleged to have approached RICHARD GARDENER and begun attacking him, RICHARD GARDENER allegedly attempted to defend himself, bringing upon him the attentions of DEAN TWIGG whom allegedly approached RICHARD GARDENER and began punching him. RICHARD GARDENER allegedly attempted a defence, but was pushed and fell, and hit his head knocking him unconscious.

MR GARDENER suffered:

  1. A fractured right radius at the distal end which forms part of the wrist joint

  2. A broken nasal bone

  3. Bruising to the left zygomatic bone and maxilla

  4. Two broken ribs and bruising

  5. Lacerations to the face including several to the upper eye lid

  6. Cerebral edema

Okay, I won't give my whole sob story about yesterday's regionals, but I do have one ethical question to propose to you other Mock Trial people.

If one of the evaluators knows which team is which and is a mother of a member on a competing team, should she be allowed to evaluate at all?

Mock trial doesn't start until December but I am already PUMPED!!!!!!

Questions for other New Yorkers: Is the case this year going to be civil, since last year's was criminal? (This will only be our school's third year of mock trial.) AND why are we not in nationals????

Hello everyone!

I've been a member for a while, but wanted to post real quick since I'm very excited.

I graduated from Beloit College in 2005 with a degree in English and Education. I'm currently working as a legal assistant while I study for the LSAT and get all of my application materials together.

I'm also going to be coaching a high school team this fall. I'm incredibly excited about it and can't wait to start.

I don't remember when I joined this community, but here I am now, to add some activity to the group by posting, finally.

Greetings, all! My name is Robin; I graduated HS in California in 2004 and am currently attending UCSB as a history major. I did mock trial all four years of high school, and was captain of the team my last year. I have been both a witness and an attorney, and have worked on general team issues as well. If any current mock-trialers have questions or need advice, I'd be pleased to offer help, as I miss mock trial greatly in college.

I know the season's not started yet, but good luck to everyone!

Wow, this group hasn't been updated in a long time, huh?

Well, it's dead in the mock trial season right now, so nothing's really going on in my team. However, I recently got a Facebook and discovered that there was no mock trial group for people who did mock trial in high school, so I took the liberty of creating one.

Hello,
So me and my friend were watching Southpark and were wondering about legal issues concerning Cartman. So Cartman told someone there was a sick pony on this ranch. Then Cartman told the owner of the ranch someone will be coming to steal his pony and to keep watch. The ranch owner shoots and kills that person that night who trespasses. Did Cartman do anything illegal? Exactly what? Keep in mind he did have the intention of having the person killed.

Since Cartman is only in elementary I doubt they could do much except send him to a mental institution. What if Cartman was an adult?

My argument is that someone who trespasses knows the risks of being killed because the owner has that right to "protect" themselves. Most of my friends are against me on this and I can understand why it's completely morally wrong but I don't know what they'd charge him with?

Hey, I'm from Wisconsin - a sophomore, this was my first year doing Mock Trial (last year, it was more of a secret society -- as much as i wanted to do it, I couldn't find out how to get in!) and we just had regionals yesterday. So much fun. I must admit I'm not liking the whole "don't find out how you do for another few weeks" (not sure if this is Wisconsin-specific or not); we definitely didn't win (we were mostly sophomores and freshmen -- a "B Team") but most of our cases were fairly close.

Our case this year was kind of interesting -- a pardon board hearing. Basically, it was based on a real event that happened in Madison: a student blew up an Army research center to protest the Vietnam war, and now he's asking for a pardon. I guess it was a unique, historical case, but I wasn't liking the hugely opinionated aspect of it. On the plus side, everyone's told me that we'll all be very well prepped for next year, as there's no way the case could be more abstract.

Well, I'm happy my co-counsel is no longer coughing up blood, and I'm really hoping that one of our witnesses doesn't die. I'd really have to kill her because it would mean we're stuck w/ our backup, who has yet to grasp the concept of punctuation. Dead serious. You know when someone reads aloud and they really suck at it? That's how she TALKS.

So...yeah.

Too bad NDCL isn't allowed to compete for 3 years. It would have been amusing to watch them compete drunk like they did at State.

I don't care as long as we don't have to go up against a certain school again, who's team is primarily composed of ESL girls. Cause it was sooooo unfair last year.

this is a random question, and probably shows my age...but, any other law school mock trialers on here? if so, which tournament are you doing this spring?

i'm on the law school team at washington university in st. louis, and my squad is going to ATLA. (we have two squads going to that, and two squads going to NTC.) i can't say our case is factually the most interesting, it's a case about a defective piece of construction equipment, but legally it's getting more amusing the more we work on it. :)
